Impact of the new regulation on packaging and its residue management

The new Regulation (EU) 2025/40 of the European Parliament and of the Council of 19 December 2024 about packaging and packaging waste, amending Regulation (EU) 2019/1020 and Directive (EU) 2019/904 and repealing Directive 94/62/EC, was published on January 22, 2025.

The new European Regulation represents an important step in the prevention of packaging waste generation and in the creation of a market for secondary raw materials.

It brings important developments on the reduction of excessive packaging, promotes the use of reusable packaging, restricts the use of certain packaging formats (such as single-use plastics) and chemicals, and establishes harmonized criteria for extended producer responsibility systems, with the intention that all packaging will be recyclable by 2030. Most relevant for us is that it incorporates new obligations in packaging labeling and information requirements.

Some aspects that were previously voluntary will now be mandatory. In our case, for food supplements, the labeling must include the fraction or container in which the product packaging waste must be deposited, by incorporating the corresponding symbol for recycling.

It is a directly applicable regulation that will come into force 20 days after its publication and will be mandatory for all European Union Member States as of August 12, 2026.
